Framework Overview

What is Remedy Integrity™?

Remedy Integrity™ is a governance principle that evaluates whether institutional decisions preserve the practical effectiveness of legal rights and remedies throughout a decision-making process.

Traditional governance frequently measures whether individuals have access to legal procedures.

Remedy Integrity™ asks a different question.

Will those procedures still be capable of delivering meaningful justice by the time they conclude?

This distinction shifts institutional thinking away from procedural completion and towards substantive justice.

A legal right has little practical value if the remedy capable of restoring that right has already been lost through irreversible administrative or judicial action.

Remedy Integrity™ therefore requires institutions to preserve not only legal proceedings, but the practical effectiveness of the outcomes those proceedings are intended to deliver.

The Governance Problem

Across justice systems, regulators and public authorities, legal rights are often preserved procedurally while practical remedies steadily disappear.

Assets are sold.

Homes are transferred.

Evidence deteriorates.

Witnesses disappear.

Funding is exhausted.

Opportunities for restoration diminish.

The legal process continues.

The practical value of the remedy declines.

By the time a final determination is reached, the legal question may still be answered, yet the ability to restore the original position has been substantially weakened.

Remedy Integrity™ identifies this as a governance failure rather than simply a procedural consequence.

The Core Principle

Justice is not preserved simply because proceedings continue.

Justice is preserved when institutions actively protect the practical effectiveness of the remedies those proceedings may ultimately require.

This principle applies equally to:

• courts;

• regulators;

• housing providers;

• local authorities;

• safeguarding partnerships;

• healthcare organisations;

• financial institutions;

• professional regulators;

• public bodies exercising statutory powers.

The Five Principles of Remedy Integrity™

1. Preservation

Institutions should identify whether proposed decisions could create irreversible consequences before material legal issues have been determined.

Questions include:

• Can the original position still be restored?

• Will future decisions retain practical value?

• Are irreversible actions genuinely necessary?

2. Proportionality

Operational decisions should balance efficiency with the preservation of substantive legal rights.

Administrative convenience should never outweigh the effectiveness of justice.

3. Practical Justice

Institutions should evaluate outcomes based upon real-world consequences rather than procedural completion.

The existence of a legal hearing does not necessarily mean justice remains practically achievable.

4. Accountability

Decision-makers should be able to demonstrate why irreversible actions were proportionate, lawful and consistent with preserving effective remedies.

Governance requires transparent reasoning capable of independent scrutiny.

5. Future Restoration

Every significant decision should consider:

If the individual ultimately succeeds, will meaningful restoration still be possible?

If the answer is no, Remedy Integrity™ requires institutions to carefully reconsider whether the proposed action is compatible with good governance.

• transparent decision-making;

• lawful exercise of discretion;
