SAFECHAIN™ Intelligence Hub Publishes Policy Analysis on “The Procedural Economy of Exhaustion”

Samantha Avril-Andreassen calls for urgent recognition of litigation endurance, financial attrition and procedural harm as systemic justice issues affecting victims of domestic abuse and coercive control.

SAFECHAIN™ Intelligence Hub has published a new legal and policy article titled “The Procedural Economy of Exhaustion: Litigation Endurance, Financial Attrition and the Structural Mechanics of Procedural Harm.”

The article forms part of Season 8 of Silent Screams, Loud Strength: Unmasking Justice and examines how prolonged litigation, economic pressure, evidential imbalance and fragmented safeguarding systems can erode meaningful participation within the justice process.

Written by Samantha Avril-Andreassen, founder of SAFECHAIN™ and author of Unmasking Justice, the article argues that modern legal systems too often measure fairness by procedural completion rather than by whether a vulnerable party can meaningfully participate throughout proceedings.

At the centre of the article is the concept of a “procedural economy of exhaustion” — a term used to describe the structural condition in which litigation endurance becomes a form of power. The analysis considers how coercive control, non-disclosure, housing instability, financial attrition, trauma and institutional fragmentation may combine to produce procedural disadvantage.

The article raises urgent questions around:

  • Article 6 fair trial rights;

  • equality of arms;

  • domestic abuse and coercive control;

  • financial remedy proceedings;

  • evidential asymmetry;

  • trauma-informed justice;

  • safeguarding continuity;

  • and operational accountability across courts, banks, housing systems and regulators.

Samantha Avril-Andreassen states:

“A justice system cannot claim fairness where survival becomes the price of participation. Procedural fairness must mean more than attendance, compliance and endurance. It must mean meaningful participation, operational safeguarding and institutional accountability.”

The publication forms part of SAFECHAIN™’s wider policy work examining how justice, finance, housing and safeguarding systems can be restructured to prevent institutional harm.

The article also strengthens the developing framework behind SAFECHAIN™’s proposed safeguarding infrastructure, which calls for greater interoperability between agencies, stronger protection for vulnerable parties, and clearer operational standards where coercive control, economic abuse or procedural imbalance are present.
